If I were to ride a scooter on the freeway, I wouldn't feel comfortable in something with less than 400cc. Anything less and you just don't have enough power to accelerate in a safe enough manner. In order to ride the scooter, you'll need an M1 endorsement on your driver's license and insurance. Insurance for scooters is pretty cheap, I used to pay $80/yr for liability only for my 50cc Zuma.
